Sleep Police Terms And Conditions

These Terms And Conditions ("Terms") are a legal agreement between you and Touchgrass Health, LLC, a Delaware limited liability company ("Touchgrass Health," "we," "us," or "our"). These Terms govern your access to and use of Sleep Police, including our mobile app, web app, websites, backend services, SMS messages, payment and penalty features, enforcement tools, and related support services.
By creating an account, using Sleep Police, requesting a verification text, setting up enforcement, saving a payment method, or otherwise using the service, you agree to these Terms. If you do not agree, do not use Sleep Police.

Eligibility
Sleep Police is intended for adults 18 and older. You may not use Sleep Police if you are under 18.
You may use Sleep Police outside the United States, but the service is operated from the United States and some features, carriers, payment methods, app-store availability, legal rights, and compliance requirements may vary by country. You are responsible for using Sleep Police only where lawful for you.
What Sleep Police Does
Sleep Police is a bedtime commitment and accountability tool. It is designed to help you define sleep-related rules, protect bedtime windows, and add friction or consequences when you intentionally bypass those rules.
Depending on your device, settings, and feature availability, Sleep Police may:
- let you sign up or sign in with your phone number;
- send account authentication, security, billing, support, enforcement, reminder, and service-related messages;
- help you configure bedtime schedules, sleep windows, geofences, penalties, cheats, and related settings;
- request mobile permissions such as notifications, exact alarms, Accessibility, foreground or background location, and app-link or browser handoff permissions;
- use Android exact alarms and Accessibility-based local app blocking to enforce a bedtime window;
- allow you to intentionally unblock or bypass enforcement by using an accrued cheat, accepting a zero-dollar waiver, or paying a configured penalty;
- record enforcement history, payment consent, payment attempts, penalty obligations, device health, and suspected circumvention signals.
Sleep Police is not guaranteed to prevent phone use, internet use, sleep procrastination, uninstalling, permission changes, device tampering, or every possible bypass.
Accounts And Phone Sign-In
Sleep Police uses phone-number-based account verification. When you request sign-up or sign-in, we may send you a short-lived verification link by text message. You are responsible for providing a phone number that you control and for keeping access to your phone, device, and account secure.
You may not create accounts for other people without authorization, use another person's phone number, impersonate another person, bypass verification, or interfere with another user's account.
If your phone number changes, your device is lost, or you lose access to your account, contact support@touchgrass.health. We may require verification before restoring or changing account access.
SMS Terms
Program name: Sleep Police.
Program description: Sleep Police may send account authentication, security, billing, support, enforcement, reminder, and service-related text messages. Current sign-up and sign-in flows send one-time account verification links after you enter your mobile phone number and request a text. Optional reminder or enforcement texts may be sent only when those features are available and you request or enable them.
Message frequency: For authentication, message frequency is one message per sign-up, sign-in, or verification request, plus any additional messages you request by repeating that flow. Other service, billing, support, enforcement, or reminder message frequency varies based on your account settings, feature use, and support interactions.
Message and data rates may apply. Message delivery is not guaranteed and may be delayed, filtered, or blocked by carriers, device settings, network conditions, or service-provider issues. Carriers are not liable for delayed or undelivered messages.
Reply HELP for help. You can also email support@touchgrass.health.
Reply STOP to opt out of SMS messages where supported. After you opt out, we may send a confirmation message and then stop sending SMS messages to that number unless you later opt back in or request another verification message. Opting out of SMS may prevent you from using phone-based sign-in or receiving important account, security, billing, enforcement, or support messages.
Consent to optional reminder, enforcement, promotional, or non-essential SMS is not a condition of purchase. Some phone-based authentication and account security messages are necessary for using features that rely on SMS sign-in.

Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using Sleep Police, you also agree to the Privacy Policy.
Sleep Police does not sell personal data. We do not use personal data for third-party advertising. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
Mobile Permissions And Device Requirements
Sleep Police depends on device features and permissions. Disabling, revoking, blocking, restricting, or changing permissions may limit or break Sleep Police. This includes, where applicable, notifications, exact alarms, Accessibility permissions, location permissions, app-link permissions, battery optimization settings, background execution, network access, Google Play services, browser access, and payment or app-store services.
You are responsible for configuring your device in a way that lets Sleep Police work as intended. Device manufacturers, operating systems, carriers, app stores, battery managers, Accessibility settings, parental controls, enterprise device management, firewalls, and other software may interfere with Sleep Police.
On-Device Enforcement
On Android, Sleep Police may request Accessibility permission to support enforcement. The Accessibility-based feature is designed to enforce your selected rules on your device. It may detect when selected apps are opened during an enforcement window and return you to Sleep Police or another safe surface.
Sleep Police is not a general-purpose device-management, parental-control, security, or emergency service. We do not guarantee that any particular app, site, service, or emergency path will remain available.
You must not configure Sleep Police in a way that could endanger you or others, prevent emergency communication, interfere with legally required access, or block critical medical, safety, caregiving, employment, school, or household responsibilities.
Emergency, Safety, And Important Access
Sleep Police is not an emergency service, safety system, medical service, security service, parental-control system, or guaranteed access-control system.
You are responsible for maintaining alternate access for emergencies and important needs. Do not rely on Sleep Police to preserve or block access to 911, emergency services, medical care, caregivers, employers, schools, family members, transportation, banking, security systems, or other critical communications or services.
If using Sleep Police would create a safety risk, legal risk, employment risk, caregiving risk, health risk, or other serious risk, do not use it or disable the relevant enforcement before the risk arises.
Health Disclaimer
Sleep Police is a behavioral tool. It is not medical advice, a medical device, a clinical service, therapy, treatment, diagnosis, or healthcare service. Sleep Police does not diagnose, treat, cure, prevent, or mitigate sleep disorders, mental health conditions, medical conditions, addiction, compulsive use, anxiety, depression, insomnia, circadian rhythm disorders, or any disease or health condition.
Sleep needs and sleep timing vary by person. If you have insomnia, excessive sleepiness, a sleep disorder, a mental health concern, a medical condition, or any concern about whether Sleep Police is appropriate for you, talk to a qualified professional.
Penalties, Cheats, And Payment Features
Sleep Police may include optional real-money penalty features. These features are designed to let you precommit to financial consequences if you intentionally bypass or deactivate enforcement during an active window.
Penalty features apply only when they are available, you have configured them, and you have accepted the applicable payment and billing terms. Saving a payment method during setup does not itself create a charge. A charge may occur only when the app or server determines, based on the applicable feature state, that a configured penalty should apply.
Depending on your settings and feature availability, penalties may apply to manual deactivation, intentional unblocking, uninstall circumvention, clearing app data, disabling required permissions, tampering with enforcement, failed payment recovery, or other bypass behavior disclosed in the product flow. Penalty amounts, currency, minimums, maximums, reductions, grace periods, cheats, waivers, and related settings may be configurable in the product.
Penalty previews are estimates. The final charge decision may be recomputed at the time of the attempted bypass or payment, because schedules, time zones, cheats, waivers, payment method state, and server records can change.
Payments are processed by third-party payment processors such as Stripe. We do not store full card numbers or full bank account numbers. Your payment method issuer, bank, payment network, payment processor, app store, or other provider may impose separate terms, fees, holds, declines, chargebacks, or processing delays.
If a payment is accepted into processing and later fails, your account may show an unresolved obligation. We may require you to repair unresolved payment obligations before additional paid bypasses or certain account features are available.
Refunds
We want penalty features to be fair and understandable. If you believe a penalty was charged by mistake, was caused by a product error, or should be refunded for any reason, contact support@touchgrass.health.
Our current posture is to review refund requests liberally. We expect to grant most reasonable refund requests, especially for product errors, accidental charges, unclear flows, duplicate charges, or early reliability issues.
We reserve the right to deny, limit, delay, or condition refunds where we suspect fraud, abuse, repeated bad-faith use, chargeback abuse, payment manipulation, account sharing, or intentional circumvention. Where permitted by law and payment-network rules, we may subtract unrecoverable processing fees or third-party fees from a refund.
Refunds do not automatically remove enforcement history, account records, payment consent evidence, fraud-prevention records, or other records we need for legal, accounting, tax, security, dispute, audit, or service operation purposes.
Anti-Circumvention And Acceptable Use
Sleep Police is a commitment product. You agree not to misuse, interfere with, or circumvent Sleep Police or help others do so.
You may not:
- reverse engineer, decompile, copy, scrape, attack, overload, or interfere with Sleep Police except where applicable law gives you a non-waivable right;
- bypass phone verification, session controls, payment controls, enforcement checks, or rate limits;
- use Sleep Police for spam, harassment, unlawful monitoring, stalking, coercion, threats, or control of another person;
- use another person's phone number, device, payment method, account, or identity without authorization;
- tamper with enforcement, clear data, uninstall, disable app blocking, disable exact alarms, block network access, revoke required permissions, or manipulate device time or location for the purpose of evading configured commitments;
- exploit bugs, duplicate requests, payment processor states, chargebacks, refunds, or race conditions to receive unauthorized access, credits, waivers, refunds, or unblocks;
- use Sleep Police where doing so would violate law, carrier rules, payment rules, app-store rules, or third-party rights.
Some actions, such as uninstalling the app or changing permissions, may be allowed by your device but still count as circumvention under your configured Sleep Police commitments.
Suspension And Termination
We may suspend, restrict, or terminate access to Sleep Police, refuse support, remove features, block sign-in, require payment repair, or delete accounts if we believe you violated these Terms, created risk for us or others, abused refunds or chargebacks, failed to resolve payment obligations, used the service fraudulently, attempted to bypass enforcement or payment systems, created a safety concern, or used Sleep Police unlawfully.
You may stop using Sleep Police at any time. You may request account deletion at https://thesleeppolice.com/account-deletion or by emailing support@touchgrass.health. Some records may be retained as described in the Privacy Policy.
App Stores, Carriers, And Third-Party Services
Sleep Police may depend on third-party services, including app stores, payment processors, SMS providers, cloud hosting providers, analytics and diagnostics providers, mapping providers, push-notification providers, operating systems, device manufacturers, carriers, and browsers.
Third-party services are governed by their own terms and policies. We are not responsible for third-party outages, delays, filtering, restrictions, declines, fees, errors, security incidents, policy changes, or feature changes.
If you download Sleep Police through an app store, the app store is not responsible for Sleep Police, support, claims, enforcement behavior, SMS messages, penalties, refunds, or disputes except to the extent required by the app store's own terms or applicable law.
Intellectual Property
Sleep Police, Touchgrass Health, the Sleep Police name, logos, designs, software, code, workflows, documentation, graphics, text, and related materials are owned by Touchgrass Health or our licensors and are protected by law.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Sleep Police for your own lawful personal use.
You may not copy, modify, distribute, sell, lease, sublicense, host, or exploit Sleep Police except as allowed by these Terms or applicable law.
Feedback
If you send ideas, suggestions, bug reports, feature requests, or other feedback, you grant Touchgrass Health a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation.
Changes To Sleep Police
Sleep Police is evolving. We may add, remove, pause, modify, test, limit, or discontinue features at any time, including enforcement features, SMS features, payment features, penalty logic, cheat logic, app handoff, web setup, device support, geofencing, analytics, diagnostics, and support workflows.
We may also impose limits on usage, accounts, messages, devices, support, refunds, or payments.
Disclaimers
Sleep Police is provided "as is" and "as available." To the fullest extent permitted by law, Touchgrass Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, security, and error-free operation.
We do not guarantee that Sleep Police will work on every device, prevent every bypass, deliver every SMS, process every payment, enforce every rule, preserve every account state, maintain every schedule, detect every circumvention event, or produce any sleep, health, behavioral, financial, or productivity outcome.
Some jurisdictions do not allow certain disclaimers, so some of these disclaimers may not apply to you.
Limitation Of Liability
To the fullest extent permitted by law, Touchgrass Health and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, loss of goodwill, personal injury, sleep loss, health outcomes, device issues, emergency access issues, carrier failures, payment failures, or business interruption, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Sleep Police or these Terms will not exceed the greater of: (a) the amount you paid to Touchgrass Health for Sleep Police in the 12 months before the event giving rise to the claim; or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Touchgrass Health and its owners, officers, employees, contractors, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use or misuse of Sleep Police, your violation of these Terms, your violation of law or third-party rights, your payment disputes or chargeback abuse, your circumvention of configured commitments, or your use of Sleep Police in a way that creates safety, medical, legal, employment, caregiving, or emergency risk.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except to the extent federal law applies or applicable consumer-protection, privacy, or other mandatory law gives you rights that cannot be waived by contract.
Informal Dispute Resolution
Before filing a claim, you and Touchgrass Health agree to try to resolve the dispute informally. To start informal dispute resolution, email support@touchgrass.health with your name, account phone number if applicable, a description of the dispute, and the relief you want. We will try to resolve the dispute within 30 days.
Either party may seek emergency injunctive relief, protect intellectual property, or file in small-claims court without completing this informal process where permitted by law.
Arbitration And Class Action Waiver
Please read this section carefully. It affects how disputes are resolved.
Except for disputes that qualify for small-claims court or claims for emergency injunctive relief or intellectual-property protection, you and Touchgrass Health agree that disputes arising out of or relating to Sleep Police or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless another arbitration provider or process is required by applicable law.
The arbitration will be conducted on an individual basis. You and Touchgrass Health waive the right to bring, join, participate in, or receive money from a class action, collective action, private attorney general action, or other representative proceeding, to the fullest extent permitted by law.
You may opt out of this arbitration agreement and class action waiver by emailing support@touchgrass.health within 30 days after you first accept these Terms. Your opt-out email must include your name, account phone number if applicable, and a clear statement that you opt out of the arbitration agreement and class action waiver in the Sleep Police Terms.
If this arbitration agreement is found unenforceable for a particular claim, that claim may proceed in court, but the class action waiver remains in effect to the fullest extent permitted by law. If the class action waiver is found unenforceable for a particular claim, that claim must proceed in court and not in arbitration.
Court Venue
For any dispute that is not subject to arbitration and cannot be brought in small-claims court, you and Touchgrass Health consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, except where applicable law requires otherwise.
Changes To These Terms
We may update these Terms from time to time. The "Last updated" date at the top shows when these Terms were last changed. If we make material changes, we will provide notice as required by law or through the app, website, email, SMS, or other reasonable means. Your continued use of Sleep Police after updated Terms become effective means you accept the updated Terms.
Miscellaneous
These Terms, together with the Privacy Policy and any feature-specific terms you accept, are the entire agreement between you and Touchgrass Health regarding Sleep Police.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or operation of law.
